KPCN-LP will be operated by PCUN, the labor union for Oregon's farmworkers and treeplanters. The Biological and Toxin Weapons Convention (1975) prohibits any signatory from ever developing, producing, stockpiling or otherwise acquiring microbial or other biological agents that have no peaceful purpose. The U.S., through the Department of Homeland Security, is claiming that its plans to build an unusually secretive National Biodefense Analysis and Countermeasures Center qualify under this exception. But critics claim that the facility will violate the Convention, and further spur an expanding global interest in producing biological weapons. Ed Hammond from the Sunshine Project joins me to discuss this particular issue, and biological weapons research in general.

We investigated efforts within Congress ( HR 3277, HR 2470, S 3521) to create a sunset commission, despite broad public opposition, which could force federal programs to plead for their existence before an unelected body with the power to recommend whether they live, die, or are minimized. The Bush plan is led by Clay Johnson III (also), Director of the White House Office of Management and Budget (wiki).

Network neutrality is a hot topic across the political spectrum, with the House approving one bill, without an important amendment _(PDF), and not granting another _(PDF) a vote. The issue has moved to the Senate where competing bills (Stevens, Snowe/Dorgan) are moving through committee, with full floor votes anticipated in July. If you use the internet (and you are now), you should take a look at this issue, as it will likely impact your future ability to ramble around the internet in the way you've been accustomed. Jeanine Kenney, Senior Policy Analyst with Consumers Union was my guest today.

The state secrets privilege (also), created from a 1953 Supreme Court ruling (U.S. v. Reynolds) that hinged on fraudulent testimony (1,2,3,4) is a series of United States legal precedents allowing the federalgovernment the ability to dismiss legal cases that it claims would threaten foreign policy, military intelligence or national security. The Bush administration has employed this tactic vastly more frequently than any other, contributing to elevated concern regarding its commitment to constitutional rule.

Joining the program are William Weaver, among the few to write about the privilege from an academic perspective, an Associate Professor of Political Science at the University of Texas - El Paso, and Michael Avery, a Suffolk University law professor who has been involved with the Center for Constitutional Rights on a lawsuit recently challenged by a Justice Department petition _(pdf) based on the state secret privilege.
